A. TERMS OF USE FOR THE GENERAL USER:

You may use Daily-Update’s name and graphics for your Web pages, provided that:
(a) such use is respectful and decent;
(b) you do not infringe Daily-Update’s COPYRIGHT;
(c) you leave intact all Daily-Update identifiers (including our name and images); and
(d) you provide a notice acknowledging any intellectual property of Daily-Update.

 We reserve the right to withdraw the above permission at any time.

 All this is admittedly rather hazy, so please contact Daily-Update if in doubt and we will do our best to accommodate you.

 

 

B. LEGAL NOTICE TO USERS AND DEVELOPERS OF "SCUMWARE":

Daily-Update gives notice on 24 August 2001 that, from 01 September 2001, the  overlaying of advertisers' links or other links on the Daily-Update  Website (at http://www.dupublishers.com) using "scumware" or  "predatory advertising" is strictly forbidden. "Predatory advertising" is defined as any method that creates, changes or overlays links or banners on Websites, spawns browser windows, or any method invented to generate traffic from a Website without that Website owner's knowledge, express permission, and/or participation.
Examples include, but are not limited to: keyword parsing browser  plugins such as TopText by Ezula and +Surf by Filemix and Microsoft's withdrawn Smart Tags, banner replacement technology such as Gator, browser spawning technology that is not Website dependent. Should any  party disregard this warning, it shall be taken that the party trespassing on Daily-Update's intellectual property agrees to the following terms:

 (a) Payment of US$2000 per calendar month or part thereof as payment for:  advertising; and/or the use of Daily-Update's copyright material as a  base for the said overlays; and/or compensation for the defacement of  Daily-Update's intellectual property; and/or as recompense for unjust enrichment, computer misuse, unfair business practices, trespass or  contravention of privacy laws; and/or compensation for the  diversion/stealing of Daily-Update traffic; and/or compensation for lost sales or commissions; and/or recompense for use of words and banners on  Daily-Update pages; and/or compensation for links to competitors; and/or  compensation for unfair competition; and/or compensation for  advertisements placed by Daily-Update on other sites which have been  overlaid. This sum shall be payable each period of six calendar months,  commencing 01 March 2002. The amount to be paid shall be set using the value of the US$ that is prevailing at noon on the date that payment is due.

 (b) The overlays on Daily-Update's Website shall be restricted in content. There shall be absolutely no links to adult Websites; no adult content; no promotion of sexually explicit materials; no links to casino Websites; no casino content; and no promotion of gambling. Further,  there shall be no promotion of violence or hatred. There shall be no discrimination based on race, sex, religion, nationality, ethnicity,  disability, sexual orientation, or age. Finally, there shall be no  promotion of drug-taking or any illegal or immoral activities. Breach of any of these requirements shall be taken as agreement to pay the charity, World Vision Australia the sum of US$10,000 per breach as  compensation for Daily-Update's loss of reputation. The amount to be  paid shall be set using the value of the US dollar that is prevailing at the time of the breach.

It must be clearly stated that Daily-Update has, in the interests of readability, restrained itself from putting advertisements throughout  the text. For someone else to profit by inserting highlights and  hyperlinks over our text is simply unacceptable. Few people would  knowingly choose to have scumware, particularly if they knew what it  involved, but unfortunately these free programs are often secretly bundled with appealing free software. The scumware provider is then  usually able to coordinate information on, and interact with, the  browser of the unknowing recipient.

You may see from our Privacy and Ethics Webpage that we have gone far beyond what is normal in  favouring morality and openness over commercial gain. Having worked hard at building up content of which we can be proud, we consider that we deserve the resultant control and benefits.
